These Terms and Conditions (“Terms“) govern your access to and use of Heethr’s services, features, and applications (the “Services”). By accessing or using our app, you agree to be legally bound by these Terms. If you do not agree, please discontinue use of the Services immediately.
1. Eligibility and Account Responsibility
You may use the Heethr App only if:
- You are at least 18 years old or the age of majority in your jurisdiction;
- You have the legal capacity to enter into a binding agreement;
- You comply with these Terms and all applicable laws and regulations, including those of the Province of Quebec and the federal laws of Canada.
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
2. Description of Services
Heethr is a digital productivity and project estimation platform that allows users to:
- Track tasks and manage projects,
- Estimate time, cost, and resources,
- Collaborate with teams,
- Subscribe to enhanced features for expanded functionality.
We continually update and improve the App and Services. We may add or remove features at any time, with or without notice.
3. Payment and Subscription Terms
Heethr offers both free access and paid subscription plans. Subscription services are billed on a recurring monthly basis unless canceled. Payment terms are as follows:
- In-App Payments: All monthly subscription fees are processed through Apple Pay or Google Pay, based on the platform used.
- Other Payments: Any non-subscription or custom enterprise payments are processed securely through Polvo EFT Payments.
By subscribing to a paid plan, you authorize us or our third-party processors to charge your selected payment method automatically at the start of each billing period.
You are responsible for maintaining valid payment information. Failed payments may result in account suspension or cancellation.
4. Free Trial Policy
Heethr may offer a free trial of its premium services. Upon the expiration of the trial period, unless canceled, you will automatically be enrolled into the paid subscription plan. You can cancel at any time during the trial to avoid charges.
Heethr reserves the right to modify or terminate free trial offers at its sole discretion.
5. Cancellation and Refund Policy
You may cancel your subscription at any time through your Apple or Google account settings. Cancellations take effect at the end of the current billing cycle.
Refunds are governed by the policies of Apple, Google, and Polvo EFT. Heethr does not issue direct refunds for purchases made through those platforms. Please refer to their refund policies to request a refund.
6. User Data and Content
You retain full ownership of the data and content you upload to Heethr (e.g., project files, notes, task lists). By using the App, you grant Heethr Solutions Inc. a non-exclusive, worldwide, royalty-free license to use, process, host, store, and display your content solely to provide and improve our Services.
You are solely responsible for your content and its compliance with applicable laws.
7. Acceptable Use
You agree not to:
- Use the App for unlawful, harmful, or fraudulent purposes;
- Attempt to gain unauthorized access to any part of the Services;
- Reverse-engineer, decompile, or modify any software used by Heethr;
- Interfere with the operation of the App or another user’s experience.
Heethr reserves the right to investigate and take appropriate action against violations, including account suspension or termination.
8. Service Availability
While we aim to keep Heethr running at all times, we cannot guarantee 100% uptime. The Services may occasionally be unavailable for maintenance, updates, or other reasons. We are not liable for any disruption, delay, or loss of access.
9. Termination and Suspension
We reserve the right to suspend or terminate your access to Heethr at any time, without notice, if:
- You violate these Terms;
- Your conduct harms other users or our operations;
- We are required by law or regulation to do so.
Upon termination, your access to data may be restricted, and you will no longer be able to use the paid features.
10. Intellectual Property
All intellectual property rights in the App, including its design, content, logos, trademarks, and underlying technology, are owned by or licensed to Heethr Solutions Inc. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our express written permission.
11. Disclaimer of Warranties
Heethr is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee that the Services will be secure, error-free, or meet your expectations.
12. Limitation of Liability
To the fullest extent permitted by law, Heethr Solutions Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the App or reliance on the Services.
13. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the App, you agree to the data practices described therein.
Heethr is committed to complying with Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada. Any disputes shall be resolved in the courts located in Montreal, Quebec, and you consent to the exclusive jurisdiction of those courts.
15. Changes to These Terms
Heethr may update these Terms from time to time. When changes are made, we will notify users by revising the “Last Updated” date. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
